As we start to move into the last few weeks of 2007, it’s natural to look ahead to what might happen in 2008.
Often future predictions are made off the back of what’s happened over the last 12 months. And it’s been a very busy year for the UK property market.
There have been numerous changes and predictions for the future. We take a look at what’s happened so far in 2007, and how that could affect the market next year.
First off the big issue that affects all of us – house prices.
UK property prices have had an interesting year. Some organisations have reported prices going down; others have claimed they have gone up in some areas. Overall it seems likely there has been at the very least a slowdown in the growth of prices.
The current average price for a UK property is £225,826. And the Nationwide building society says in 2007 the annual price growth was 9.7 per cent.
But a new report it has just released has predicted zero per cent house price growth in 2008.
It says UK property prices will stay exactly as they are now. This means in real terms that the value of homes will fall, as the cost of living continues to rise.
The building society blames this potential ‘freeze’ on a slowdown in the wider economy. It points out that price growth was supported in 2007 by the strength of the British economy, especially in the financial and manufacturing sectors.
But over the next 12 months it expects economic growth to slow from three to two per cent. And when that is combined with lower disposable incomes caused by the cost of petrol and other rising bills, plus high interest rates and tighter lending conditions, it’s likely to slow the economy.
The Nationwide also believes there will be a fall in demand in buy to let houses, affecting UK property.
Of course, the likelihood is that any slowdown in price growth is going to be short-term only. Many experts agree that the long-term prospects for property value growth remain good. So it’s only something to worry about if you are considering selling property in the next 18 months or so.
Let’s take a closer look at one of the factors affecting prices – interest rates.
Since August last year, rates have gone up five times. But they have stayed the same for the last three months, and many people believe they will drop before the end of the year.
If the economy does see a slowdown as predicted, it’s likely that interest rates will go down again in 2008. This is good news, as it will ease some of the financial pressures squeezing people and give them a little more disposable income. This is likely to give the economy a small boost, which may in turn be good for UK property.
The other major factor to look at for 2008 was a huge source of controversy in 2007.
Home Information Packs, or HIPs, were first introduced for four bedroomed houses on 1st August this year, and extended to three bedroomed properties on 10th September.
A survey by the Royal Institution of Chartered Surveyors in September revealed that that the number of properties needing a HIP coming onto the market continued to fall, when compared to the same month in 2006.
And 73 per cent of surveyors who responded to the survey saw a decrease in three bedroom or larger properties coming onto the market.
Experts predict that the effect of HIPs will lessen in 2008. They believe people will get used to the idea of needing to compile a document before they can put their UK property up for sale. And in time that will mean the HIPs have very little real effect on the market. Whether that will happen in 2008 or 2009 remains to be seen.

UK Commercial Property Leases; Seek Professional Advice

Businesses are being warned to avoid tempting but potentially costly shortcuts in commercial property leases. The advice comes following the publication of a new stronger code of practice that includes a step-by-step guide for tenants to negotiate a lease. Leading city law firm, Hegarty Solicitors, welcomes thecode of practice, but says it is not a substitute for expert legal advice that can often secure substantial savings for businesses and anticipate issues that arise years after a lease is signed.
New Government Backed Code
The new ‘Code for Leasing Business Premises’ that was launched in March 2007 by Housing Minster Yvette Cooper, has been published to clarify the process and aims to assist new businesses that are new to negotiating leases for shops and offices.
Commercial Property Partner Richard Hegarty says businesses might be tempted to try and handle negotiating the lease themselves, but it is their lack of experience that makes them more vulnerable, and they need to realise the importance of using experienced property lawyers.
Richard explained, “The new code is not compulsory but is regarded more as a basis for negotiation rather than a blueprint for a lease.”
”I would strongly recommend that anyone entering into lease negotiations takes expert legal advice. The code is still quite complicated, and businesses should take into consideration the time they want to spend trying to understand the lease, and what happens when something goes wrong at a later stage”
”Also, the code is standardized but every property is different. A commercial property lawyer would able to provide specialist advice on each individual scenario and know to look for anything unusual in the lease.”
Negotiating Yourself; A False Economy
He continued, “When people are starting up we know that every penny counts, and they might think they will save money handling the lease themselves. A commercial property lawyer is really like an insurance policy. We are highly experienced at negotiating leases and can often obtain a better deal than they could themselves. The savings they could make can dwarf the legal costs involved, and they have peace of mind knowing they are fully aware of their rights and commitments in the lease.”
The new code suggests that landlords may not want to tie tenants in for lengthy periods. Richard says that when a company is unsure of it’s future, perhaps because it is new or in an unstable market it can make sense to have a shorter lease period. However, many other businesses prefer to have the security of knowing they will not be looking for other premises or incurring moving costs in the near future.
”When you are busy running a business the last thing you want to contend with is the pressure of having to find new premises. The length of a lease is very important, and a commercial property lawyer would be able you help you make a decision to suit you and your business,” commented Richard.

There will always be distressed sellers in the property market, who are forced to sell due to circumstances, and in the current economic climate the numbers of those affected have increased and diversified. Nowadays that list includes people that have lost their jobs and cannot afford their mortgage, property investors who are in negative cash flow, lenders in need of liquidity or banks.
Why buy distressed property
According to experts, distressed property represents a significant opportunity and is where the market is now.
With the prospects of the economy steadily recovering, many believe that the window of opportunity for this kind of property is relatively short. According to The Council of Mortgage Lenders the UK housing market is likely to stabilise next year, but there are still good opportunities out there.
Where to buy
When looking at acquiring a repossessed property, the criteria to follow is the same as any other type of investment property, namely location, yield, value and condition.
Those that are interested in investing in a distressed property – especially if it is for buy-to-let purposes – should be looking for a location that is safe, have shops and schools around and decent transport links, otherwise it can be difficult to rent out.
Gross yield is less important than net cash flow and high service charges in some apartment blocks can decimate this. In general, however, it is relatively easy to find good-quality property that yields between 7% and 10%.
How to find distressed properties
Finding the right distressed property to buy involves a lot of hard work, research and time.
Usually the property is bought after repossession, either at an auction or through an agent. A good starting point is searching on the internet for foreclosed or distressed properties. If the affected party is a developer it is much better to deal with him before repossession since he may be willing to offer a significant discount especially if stock is purchased in bulk.
Even though some opt for employing an expert to source properties it is a good idea to do some research and see if it is worth the money you are going to be charged. In some cases they will simply give you access to a list of properties. Some other companies offer properties which have been subject to a detailed analysis and this can be a more interesting option.
Some companies even approach individuals facing repossession and offer to buy their property at a knock-down rate and to rent it back to them.
Foreclosure properties are potentially the most profitable, but require a lot of considerations and attention to detail. But being as it is possible to buy distressed property for 50-60% below what is sold for two years ago, and achieve 10% or more in rental yield is very much worth the effort.

2009 Set to be Another Difficult Year for UK Commercial Property

UK commercial property returns in 2008 are set to be the worst recorded for eighteen years and RICS has warned that commercial property values could still fall by a further 25% over 2009 and 2010. For tenants looking for commercial properties to lease this isn’t all doom and gloom as it is resulting in commercial real estate landlords offering increased inducements, incentives and sharp drops in their rents.
The credit crunch has hit the financial services and properties industries the hardest. Canary Wharf is currently one of the most exposed areas in the UK and facing the threat of increasingly empty buildings. As the financial district of London it has been hit hard by the credit crunch and potential tenants have found that there are now many bargain lets to be had.
Despite the negative effects on the financial and properties sectors some industries are in fact seeing and upturn as a result of the credit crunch and are actually seeking out more commercial property. Certain sectors are now actually in their element as a result of Britain’s tightening purse strings. Cash convertors, the Australian founded company that provides pawn broking and other cash raising services has experienced a significant growth in profits compared to previous years which corresponds with the overall decline in the economy and has actually opened a higher than average amount of new stores this year. Their customer base has widened in variety too with it now not being uncommon for city businessmen to visit the store because they need a short-term, quick cash injection.
Other industries experiencing upturns are bailiffs, tax advisers, takeaway providers and any kind of budget provider such as budget hotelier Travelodge or budget supermarket chains Lidl and Aldi. As a result of redundancies and investment downturns some people are having to make huge cutbacks however, the majority are looking for smart ways to save money that don’t affect their current lifestyle too much. For example, having a takeaway or going to a cheaper restaurant rather than fine dining; shopping at a cheaper supermarket and using cheaper hotels for business travel. Companies seeing an upturn despite or in fact because of the credit crunch are in a highly enviable position. Not only are they seeing increased profits but they are also making plans for expansion when the rest of the UK is sitting tight or planning cut backs. Their expansion plans will benefit even further from the credit crunch due to the fact there are now a lot of cut price commercial properties available to these businesses that previously may have been inaccessible.

Use UK Intellectual Property Law to Protect Your Bright Ideas

Although having bright ideas to change the way we do things is an old concept, protecting these ideas is relatively new. The phrase ‘intellectual property’ was not created until the 19th century, the idea of legal copyright however dates back to 1710 (the Statute of Anne) and the idea of patenting dates back to 1623.
The concept of intellectual property law is to enable an individual to create something and reap the benefits from this creation, this therefore encourages others to develop new ideas. Intellectual property conceptually can include so many things ranging from art work, designs, literature, phrases, software, hardware, photographs, sound combinations and visual recordings – called “creations of the mind”.
According to one economic study, intangible assets account for around two thirds of the value of big companies in the Western economies, underlining the importance of protecting those assets against being copied, stolen or lost. The international importance of protecting ideas was recognised in 1967, with the establishment of the World Intellectual Property Organisation, as an agency of the United Nations.
Only “non-rival” goods attract intellectual property rights – that is, something which can be used or enjoyed by many people at the same time, such as a piece of music. In contrast, “rival goods” can only be used by one person at a time – think of shirt, for example.
Legally, there are several ways in which intellectual property can be protected, including copyright, trademark and patent laws. But for anyone developing new ideas or products, it is vital to consider from the outset how you can protect your work. Even those who you work with on a project could potentially copy your developments, and so a first stage consideration should be the establishment of non-disclosure agreements and confidentiality agreements.
Any approach towards protecting your UK Intellectual Property Rights will inevitably require the services of an appropriately experienced legal advisor. In order to get full protection under the law you will need to employ an experienced UK IP lawyer, who will be able to negotiate the complexes of intellectual property case law. Whilst we live in a world of instant communication, ideas can be passed around quicker than we can ever imagine, because of this it has become more crucial to take early steps to protect these ideas.
