How are the statute of limitations determined for credit card default?

Friday, March 11th, 2011

I currently live in Kansas. The statute of limitations for unpaid credit card debt ‘open accounts’ is 3 years. I lived in Texas and Arizona when the credit cards were opened. How do I determine the statute of limitations for this debt? Is it based on current residency or past residency?

Bankruptcy or choosing to default on credit card debt. What are the ramifications of each?

Monday, February 14th, 2011

I have A LOT of credit card debt from opening a business and having to sell it in one year because of family responsibilities. Saw a bankruptcy attorney, but the options don’t seem to work for me as there’s no way I could ever pay off these debts.
I know it’s very immoral, but what will actually happen if I just stop paying on them? I know I’ll be inendated with phone calls and lose my good credit standing, but can they attach my bank account or any other asset?

Can I pay my student loans every other month and not go into default?

Monday, January 3rd, 2011

I have several student loans I’m paying off right now, but I don’t make enough money to pay them all every month. If I just pay off what I can, and end up only paying every other month or every third month instead, will I go into default after accruing 9 months of debt? Or is the 9 months sequential, instead of cumulative?

Why default on only 1 of your 2 home loans?

Thursday, December 16th, 2010

I’m looking at a property in pre-foreclosure. It has 2 loans, the 1st at $202,000 (2003) and a 2nd at $245,000 (2006). Only one is showing default. Assuming ForeclosureRadar’s data is correct, why would someone just default on one for 4 months and not the other?

Unless they were planning on catching up. Phase 1: Denial….

Seriously, any other reasons?

Will my federal income tax return be garnished now that I’m out of default on student loans?

Friday, December 3rd, 2010

I was in default on my student loans, but I am not anymore. Earlier this year, I received a notice that my federal income tax return would be garnished because of the defaulted loan. My loans were being serviced by a collection agency, but they have now been consolidated. My state’s loan authority shows I have no outstanding loans. Do I need to do anything or notify the IRS/Treasury Dept/anyone else that I’m out of default?
